Due to the dynamic development of RZMK Restructuring, we are looking for two experienced employees for the position of Financial Analyst, who will join our team specializing in the area of asset management in crisis situations (including restructuring or bankruptcy) and analysis of business valuations. People in these positions will be responsible for financial analysis of businesses, support of restructuring processes and preparation of detailed financial reports and recommendations for our clients. Scope of duties:
- Analysis of the financial situation of companies in the context of verifying possible insolvency as referred to in bankruptcy law.

The District Court in Opole, at a hearing on January 20, 2025, approved the arrangement that ends the restructuring proceedings of Someo SA. Thanks to the efficient restructuring conducted by qualified restructuring advisor Marcin Kubiczek, it was possible to save the workplace and retain 160 jobs, as well as satisfy most of the creditors in 100%.
Someo SA from Strzelce Opolskie is a Polish manufacturer and designer of painted plastic parts, mainly for the automotive and electronics industries. The company quickly developed its business, which was confirmed by the distinction of Gazela Biznesu by “Puls Biznesu” newspaper in 2014. However, the collapse of demand in the above industries, caused by the pandemic and the war in Ukraine, had a strong impact on the company’s financial situation. Due to the threat of insolvency, the District Court in Opole opened Someo’s reorganization proceedings, which were led by Marcin Kubiczek as a qualified restructuring advisor. They ended today with the issuance of a court decision approving the arrangement.
Thanks to the successfully conducted restructuring process, 160 jobs will be saved, and most creditors (public-law entities and trade creditors) will be repaid in 100% in one tranche. Creditor groups I-III will be fully satisfied, including, among others, the receivables of the State Treasury and trade creditors. The value of payments is counted in millions of PLN, and the money will reach the creditors even in February – in view of the expected imminent entry into force of the Court’s decision.
The trustee of Getin Noble Bank SA w upadłości, Marcin Kubiczek, decided the tender for the office part of the famous, 212-meter Sky Tower skyscraper in Wrocław. The starting price was PLN 54 million net.
The tender for the property in the Sky Tower office building in Wrocław was announced on December 9, 2024 by Sax Development, whose sole shareholder is the bankrupt Getin Noble Bank. The property for sale consists of 9 office premises and 60 garage spaces. The starting price was PLN 54 million net. On January 15, 2025, the buyer was selected in the tender.
The office part of Sky Tower is a very attractive asset, because it is 8.4 thousand sq. m of usable space in the fifth tallest building in Poland and the second outside Warsaw. It is a prestigious property, additionally connected to a commercial, service and recreational complex.
The office part of Sky Tower, the tallest building in Wrocław, belonged to the assets of the bankrupt Getin Noble Bank through Sax Development. There are still about 650 properties for sale – mainly taken over as security for debt repayment from entities that did not repay loans. By selling these assets, the GNB trustee plans to gain at least over PLN 300 million for the bankruptcy estate.
The efficient conduct of this tender and settlement of the transaction are crucial from the perspective of the bankruptcy estate of Getin Noble Bank SA w upadłości. The tender committee selected the most advantageous offer in terms of price, which was the main criterion. The GNB’s trustee is qualified restructuring advisor Marcin Kubiczek.
Only half a year after taking over as President of the Management Board of Hawe Telekom, Marcin Kubiczek managed to reach an agreement with the Industrial Development Agency. It ends the company’s restructuring proceedings, which have lasted for 9 years.
The agreement with the Industrial Development Agency SA (ARP) and the Administrator of the Sanation Estate of Hawe Telekom increases the chances of the creditors accepting the arrangement proposals and thus successfully ending the 9-year and complicated sanation proceedings of the company. Thanks to the involvement and support of ARP, it will be possible to bring the restructuring of Hawe Telekom to an end.
Additionally, ARP will become a shareholder of Hawe Telekom, which will enable the stable development of a company that plays an important role in the telecommunications market and is of great importance to the public interest.
This event is all the more satisfying because Marcin Kubiczek has been the President of the Management Board of Hawe Telekom for only half a year. In such a short time, what was impossible for many years was achieved – a breakthrough in the restructuring proceedings. The agreement reached with the Industrial Development Agency is crucial both for the development of the company and for Poland’s telecommunications security.
The long-awaited voting procedure on the arrangement proposals will begin soon, which heralds the imminent completion of the restructuring proceedings.

On December 17, the District Court in Opole issued a decision to end the bankruptcy proceedings of Twoja SKOK w Kędzierzynie-Koźlu. After several years, it was possible to bring about a positive conclusion to the process – creditors will be satisfied in about 75%. The bankruptcy proceedings were conducted by the trustee Marcin Kubiczek.
Last week, the District Court in Opole issued a decision to end the bankruptcy proceedings of Twoja SKOK w Kędzierzynie-Koźlu. Since 2017, they have been led by the trustee Marcin Kubiczek.
Twoja SKOK w Kędzierzynie-Koźlu is a cooperative financial institution for which the Polish Financial Supervision Authority appointed a receiver in 2016. Shortly afterwards, in May 2017, the KNF (Komisja Nadzoru Finansowego) suspended the operations of Twoja SKOK, at the same time filing a motion to declare bankruptcy of the cooperative fund. A month later, the District Court in Opole declared bankruptcy of the debtor Twoja Spółdzielcza Kasa Oszczędnościowo-Kredytowa w upadłości based in Kędzierzyn-Koźle.
The bankruptcy process was not the easiest ones – there were 1408 creditors on the list of receivables, and the total amount of recognized receivables amounted to over PLN 168 million. The debtor did not have assets that would allow for the satisfaction of the full pool, but thanks to the active and effective legal actions of the qualified restructuring advisor Marcin Kubiczek, it was possible to recover and repay the vast majority of receivables in category I. As part of the implementation of the division plans, the trustee transferred to the creditors a total amount of over PLN 125 million, which means that the receivables recognized in category I were satisfied at the level of approx. 75%.
100% satisfaction of creditors of the first category and almost 50% of creditors of the second category and all costs of bankruptcy proceedings covered – the bankruptcy of Neotech Mława Sp. z o. o. with its registered office in Tułowice ends successfully, despite the fact that at the beginning of the proceedings there were no assets or financial resources in the company’s assets. In the opinion of qualified restructuring advisor Marcin Kubiczek, this is a good example of how effective a tool is the use of the so-called Pauliana action.
On February 25, 2020, the court declared Neotech Mława sp. z o. o. with its registered office in Tułowice bankrupt. The proceedings are coming to an end, because on September 20, 2024, the trustee Marcin Kubiczek submitted to the judge-commissioner the final plan for the division of the bankruptcy estate funds. The trustee points out that one of the company’s creditors filed for the declaration of bankruptcy, which shows how strong instruments the creditors have against the debtor.
The beginning of the proceedings did not inspire optimism. The temporary court supervisor Krzysztof Piotrowski could not contact the debtor. The company did not comply with the orders and did not submit documentation regarding its business activities. The assets were not even sufficient to cover the costs of the proceedings, which, according to the supervisor, would support the dismissal of the bankruptcy petition. On October 11, 2019, Marcin Kubiczek became a compulsory administrator, and after the declaration of bankruptcy, the trustee of Neotech Mława.
Thanks to the effectiveness of the trustee’s actions and the use of the so-called Pauliana action, several million PLN were transferred to the bankruptcy estate during the proceedings. This was possible thanks to the filing of lawsuits to recognize past actions as ineffective. Until these funds were obtained, the bankruptcy proceedings were conducted in conditions of significant financial shortages – the trustee had to finance the costs of the proceedings from his own funds and seek external non-interest-bearing sources of financing.
The starting point was the lack of any funds to conduct the proceedings, yet it ends with 100% satisfaction of creditors of the first category, almost 50% satisfaction of creditors of the second category and coverage of all costs of the proceedings. This is the best proof that bankruptcy law in Poland works. You just have to want and be able to use the tools it offers. The total amount presented to 29 creditors for payment under the division plans amounted to several million PLN.
The icing on the cake has been placed. The District Court in Opole, in the person of the Judge-Commissioner, confirmed the acceptance of the arrangement, which was previously accepted by the creditors in 99%. Someo SA from Strzelce Opolskie was sold as part of the remedial process, and the money from the sale will be paid to the creditors. The function of the company’s administrator is performed by Marcin Kubiczek to which he was appointed by the District Court in Opole.
Over PLN 33 million – this is the total value of receivables recovered as part of the restructuring carried out by qualified restructuring advisor Marcin Kubiczek. This concerns Someo SA from Strzelce Opolskie. Thanks to this process, it will be possible to preserve 160 jobs, and most creditors (public-law entities and trade creditors) will be repaid in 100% in one tranche.

Already in March, the judge-commissioner agreed to sell the company as part of the prepared restructuring plan. Almost half a year later, the Creditors’ Council accepted the division of funds, which was possible thanks to the consensus around the sale of the plant. In this way, the creditors are satisfied by 100%, and the company continues to operate without any loss of employment.
Someo was sold to DAEJIN Advanced Materials Poland Sp. z o. o. from Bielany Wrocławskie which offered an attractive price. In this way, the restructuring process was finalized in a way that satisfied all parties.
The arrangement proposed by the administrator was accepted by the Creditors’ Council by 99% (only one entity voted against). In the next step, the District Court in Opole issued an announcement of the decision on the acceptance of the arrangement, thanks to which it will be possible to pay receivables worth over PLN 33 million. All entities covered by the arrangement will receive their receivables within 2 months of the Court’s confirmation of the finality of the decision on approval of the arrangement.
